The Resolution has been prompted by Spain’s adherence to the Protocol on Specific Matters of Aircraft Equipment and the Luxembourg Protocol on Specific Matters of Rolling Stock, both concerning international guarantees on mobile equipment.
Spain designated the Moveable Assets Register as the access point for transmitting necessary information to the corresponding international registries for registering international guarantees and notices of national guarantees. The Resolution has clarified that for aircraft equipment, the provincial Moveable Assets Register of Madrid would serve as the competent authority due to its jurisdiction over aircraft matters. However, for rolling stock, no exclusive competence regime applies.
